Man indicted for killing cyclist

The man accused of hitting and killing a West Virginia Wesleyan College cyclist on Route 20 in September 2008 was indicted by an Upshur Grand Jury Monday.

Roger Lee Harrison Jr., 23, of French Creek, was indicted for driving under the influence of alcohol contributing to the cause of death, a felony, and leaving the scene of an accident with death, a felony.

Harrison, driving a 1988 Ford pick up truck, allegedly struck the bicycle being ridden by Daniel Duncan, 19, of Norwalk, Ohio. Duncan died after suffering severe injuries in the accident. Harrison left the scene and was found 1 1/2 hours later in Adrian.

A total of 29 people were indicted by the Upshur County Grand Jury.

Lisa A. Osburn, 45, of Buckhannon, who recently resigned her nurse director position with the Upshur-Buckhannon Health Department, was indicted for obtaining a controlled substance by fraud, forgery, deception or subterfuge, a felony, four counts. Osburn allegedly forged various prescriptions from February through May 2008 at several local pharmacies.

William James Miller, 48, of Buckhannon, was indicted for breaking and entering, a felony, and grand larceny, a felony. On October 26, 2008, Miller allegedly entered a storehouse owned by Johns Brothers Inc. at Deer Creek Ridge Development and stole two Paslode gas operated framing nailers, one DeWalt circular saw, one DeWalt reciprocating saw and one Milwaukee right angle drill. The items taken represented a total value of $1,075.

Vickie Lynn Davidson, 42, of Buckhannon, and Tony Vincent Herndon, 41, of Buckhannon, were indicted for forgery and uttering, felonies, and two counts of felony conspiracy. On September 17, 2008, the two allegedly forged another personís name on a check from the state treasury for $599.

Paul Francis Tenney, 63, of Looneyville, was indicted for grand larceny, a felony. Tenney allegedly took a Massey Ferguson 253 diesel tractor, one Gato 18 foot tractor, one potato plow and one three-point hitch valued at $16,050, all belonging to a local resident.

Jerry David Shreve Jr., 41, of Buckhannon, was indicted for child abuse by a parent, guardian or custodian resulting in bodily injury, a felony, two counts. Shreve allegedly physically beat a 2-year-old and 3-year-old, for whom he is a parent or guardian, on December 16, 2008.

Harry Jackson Riley, 33, address unknown, was indicted for fraudulent scheme, a felony. Between July 27 and August 4, 2008, Riley allegedly made a series of 900 telephone number calls on another personís phone without permission for a total of $1,430.21.

Conley H. Gregory, 48, of Rock Cave, was indicted for malicious assault, a felony, and wanton endangerment involving a firearm, a felony, two counts. On December 10, 2008, Gregory allegedly shot and wounded a man in Goshen.

Rickie L. Riley, 42, of Buckhannon, and David Melanson, 45, of Buckhannon, were indicted for breaking and entering, a felony, two counts; grand larceny, a felony, one count; petit larceny, a misdemeanor, one count; conspiracy, a felony, two counts; and conspiracy, a misdemeanor, one count. The two allegedly broke into an out building at the Middle Fork Campground and stole tools and personal property valued at $1,200. In a second outbuilding at the campground, they also allegedly took a Poulan gas leaf blower, a Black and Decker small shop vac and an air conditioner valued at $725.

Timothy Corder, 50, of Buckhannon, was indicted for possession of a counterfeit controlled substance, cocaine, with intent to deliver, a felony; and conspiracy, a felony. Corder allegedly conspired with another individual to deliver the counterfeit cocaine.

Hubert R. Gregory, 68, of Adrian, was indicted for driving while license revoked for DUI, third or subsequent offense, a felony. Gregory allegedly drove a 1997 Dodge Ram on November 17, 2008 on Route 20 South near Hinkleville. Gregoryís license was revoked in Lewis County in 2001 and he had two prior convictions for driving while revoked for DUI.

Brock Adam Miller, 18, of Volga, was indicted for grand larceny, a felony; attempted breaking and entering, a felony; conspiracy, a felony, two counts; petit larceny, a misdemeanor, 14 counts; and conspiracy, a misdemeanor, seven counts.

Miller allegedly conspired with a juvenile and broke into several homes in September and October 2008. The items taken were valued around $3,500.

John Wayne Plivelich, 28, of Buckhannon, was indicted for fleeing in a vehicle while DUI, a felony; driving under the influence of alcohol, second offense, a misdemeanor, two counts. Plivelich allegedly drove a 2000 Chevy Cavalier with a blood alcohol concentration of .08. He had a previous conviction in 2002.

William Thomas Wolfe, 25, of Buckhannon, was indicted for domestic battery, third or subsequent offense, a felony, one count; burglary, a felony, one count; and battery, a misdemeanor, one count. Wolfe allegedly broke into a Wood Street residence with the intent to commit domestic battery against a victim and struck the two victims in the face with his hands.

Christopher John Thrain, 39, of Buckhannon, was indicted for delivery of a controlled substance, a felony, and delivery of a counterfeit controlled substance, a felony. Thrain allegedly delivered cocaine and counterfeit cocaine to another individual in February 2007.

Jeremy Marshall Jordan, 27, of Weston, was indicted for forgery and uttering, a felony, three counts. Jordan allegedly forged checks made out to him for $100, $125 and $70.

Scott Dale Tenney Sr., 36, of Weston, and Robert Edward Sprouse, 21, of Buckhannon were indicted for forgery and uttering, a felony; conspiracy to commit forgery, a felony; and conspiracy to commit uttering, a felony. Tenney and Sprouse allegedly forged and uttered a check from the United States Treasury.

Bruce Wayne Payne, 26, of Century, was indicted for child abuse by parent, guardian or custodian resulting in serious bodily injury, a felony. Payne allegedly abused a six-month-old infant in July 2008 causing serious bodily injury.

Jesus S. Garcia, 44, of Buckhannon, was indicted for sexual assault in the third degree, a felony. Garcia allegedly sexually assaulted a 12-year-old girl in October 2008.

Crystal Jo Brady, 29, of Buckhannon, was indicted for breaking and entering, a felony, and petit larceny, a misdemeanor, two counts. Brady allegedly entered a back room at The Donut Shop taking two purses and the contents valued at over $100.

June Ann Mealey, 40, of Buckhannon, was indicted for petit larceny, second offense, a felony; shoplifting, a misdemeanor; disorderly conduct, a misdemeanor; public intoxication, a misdemeanor; and tampering with a motor vehicle, a misdemeanor.

Mealey allegedly entered a vehicle outside Cookís Grocery on Island Avenue and took a purse and carton of cigarettes and then entered the building with the purse, where the owner of the purse recognized the item and alerted authorities.

Kevin James Cline, 30, of Buckhannon, was indicted for possession of a substance used as a precursor to manufacture methamphetamine, a felony; possession of a controlled substance, methamphetamine, a misdemeanor; no proof of insurance, a misdemeanor; and driving while license revoked for DUI, second offense, a misdemeanor. On July 1, 2008, Cline allegedly possessed meth and items used as a precursor to meth while operating a motor vehicle.

Paul Remy, 36, and Robin Renee Remy, 23, both of Hill Top, were indicted for breaking and entering, a felony, three counts; conspiracy, a felony, three counts; and petit larceny, a misdemeanor, six counts. The two allegedly entered a building adjoining Rent World USA and a private residence between September and December 2008 and took several items.

Roger Hibbs, 57, of Buckhannon, was indicted for sexual assault in the first degree, a felony, eight counts; sexual assault in the third degree, a felony, seven counts; sexual abuse by a parent, guardian, custodian or person in position of trust to a child, a felony, 15 counts; incest, a felony, 15 counts; and sexual exploitation of a child by a parent, guardian or custodian, a felony, six counts. Hibbs allegedly sexually abused the child over a several year period.

Jerry David Shreve Sr., 58, of Buckhannon, was indicted for domestic battery, third or subsequent offence, a felony; possession of a controlled substance, a misdemeanor, two counts; and obstructing an officer, a misdemeanor, stemming from a December 2008 incident.
